Before joining Christmann Legal, Ms. Toledo-Hermina worked as an immigration attorney with Rawls, Scheer, Foster and Mingo, PLLC in Charlotte. Ms. Toledo-Hermina  is a member of the American Immigration Lawyers Association (AILA) and the Mecklenburg County Bar. Ms. Toledo-Hermina  graduated with a Juris Doctor from City University of New York School of Law.

Upstate immigration office feels impact of travel ban

Attorney Daniel Christmann was recently interviewed by a reporter of the German national news station n-tv. He shared his professional view on the development of German-American business relations under the new administration. She jumped and hugged her lawyer Daniel Christmann when he told his Honduran client Marta Cruz-Gomez that she was granted asylum last week. Mrs.Cruz-Gomez was victim of domestic violence at the hands of her husband in Honduras. After years of abuse, she finally was able to grab her older son and flee to the US border, where she applied for asylum. She found a new home in South Carolina while her lawyer Daniel Christmann fought her asylum case in immigration court. Mr. Christmann based his legal argument on a 2014 case by the Board of Immigration Appeals which recognized “victims of domestic violence who are not able to leave the relationship” as a protected group for asylum purposes. Immigration judges grant only a few asylum applications each year. This was Mrs. Cruz-Gomez's lucky year. She is not only allowed to remain in the US, but also apply for permanent residency in one year from now. In 5 years she will qualify for US citizenship. Additionally, she is able to petition for her younger son, who had found refuge with his grandparents. For Mrs. Cruz-Gomez, last week marked the beginning of a new life, a life without fear of violence toward her or her children, a life of freedom and peace.

Christmann Legal Immigration Law is pleased to announce that Attorney Tracy Stouse has joined the firm as an associate attorney. Ms. Stouse is licensed to practice law in North Carolina and focuses her practice solely on U.S. Immigration and Nationality law.

Before joining Christmann Legal Immigration Law, Ms. Stouse practiced immigration law as a solo practitioner in Charlotte. Prior to that, she worked in the immigration clinic at the Latin American Coalition. Ms.Stouse also has general business law and corporate experience from her time as an associate attorney with Jones, Walker in New Orleans, Louisiana and Kennedy, Covington, Lobdell & Hickman in Charlotte, North Carolina.

Ms.Stouse is a member of the American Immigration Lawyers Association and the Mecklenburg County Bar, where she is a member of the Immigration Section. She also volunteers with the immigration legal clinic at the Latin American Coalition.

Lawyer Daniel Christmann with Refugee Jose Gabrieles Gonzalez

Tears of relief fell from his face when Honduran native Jose Gabrieles Gonzalez was granted asylum today in the United States. Mr.Gabrieles Gonzalez was represented by lawyer Daniel Christmann in Charlotte, North Carolina. Mr.Gabrieles Gonzalez endured violent attacks from gang members in Honduras because of his sexual orientation. The proof is shown in the form of scars on his body from machetes. Because he is gay, his life and the lives of his family members were continually threatened in his native country, so in March, 2014 he decided to flee to the United States. He sought refuge with family members but was detained by U.S. Immigration and Customs Enforcement (ICE) and faced deportation.

Lawyer Daniel Christmann argued that Mr.Gabrieles Gonzalez would most likely face violent discrimination if he returned to Honduras, and that return might just cost him his life. Mr.Christmann stated that Mr.Gabrieles Gonzalez is entitled to asylum based on his proven fear of persecution on account of his sexual orientation. Only a small percentage of all asylum cases in the United States are granted. And today Mr.Gabrieles Gonzalez became part of that lucky percentage. Starting today he may live a life without the fear of being persecuted because of his sexuality.

Deferred Action for Childhood Arrivals is granted in 2-year increments and comes with work authorization, in most cases a driver's license, and in some areas, in-state tuition for public colleges and universities.

How to renew:

  • Form I-821D “Consideration of Deferred Action for Childhood Arrivals”
  • Form I-765 “Application for Employment Authorization,” and the I-765 Worksheet.
  • $465 fee for filing and biometrics will need to be paid;

When to renew:

Renewal request should be filed about 120 days (4 months) before the current employment authorization card expires. USCIS does not process renewal requests filed more than 150 days (5 months) before the current period expires. If the renewal request is filed after expiration of the employment authorization card, employment authorization lapses and unlawful presence starts to accrue. This could lead to inadmissibility consequences, as outlined here.

Important:

USCIS will conduct a new background check for those renewing DACA. If you are currently covered by DACA and consider renewing, please make sure, your criminal record is still clean. If you have been in any criminal proceedings since you applied for DACA initially, consult with an immigration lawyer before filing for renewal.
